Brazil Advances AI Governance with New Data Center Regulation and Strategic Standardization Initiatives

Brazil is advancing its governance of artificial intelligence (AI) with significant discussions focused on regulating AI data centers and enhancing the role of technical standards. The Commission of Science and Technology (CCT) recently held a public hearing addressing the regulation of AI data centers, centered on legislative proposal PL 3.018/2024 authored by Senator Styvenson Valentim from the Podemos party in Rio Grande do Norte. This bill aims to establish clear guidelines and operational standards for AI data centers across Brazil, reflecting the growing importance of AI in various sectors.

Simultaneously, the Ministry of Science, Technology and Innovation (MCTI) hosted a strategic webinar highlighting the increasing significance of technical standards in AI development and governance. The event underscored how technical norms influence the safety, quality, and interoperability of AI technologies, directly affecting Brazil’s economy, innovation capacities, and technological sovereignty. Henrique Miguel, MCTI's Secretary for Digital Transformation, emphasized that the discussion on standardization spans beyond regulation to the entire operational structure of AI technologies.

Experts at the webinar stressed Brazil’s vital role in actively shaping global AI standards rather than just adapting to international norms. This participation is crucial for ensuring standards align with national interests and scientific capabilities amidst complex geopolitical tensions. Pedro Ivo Sebba Ramalho from the Ministry of Development noted that standardized norms facilitate trade and reduce costs, while Caetano Pena from the Center for Strategic Management and Studies highlighted that technical standardization is now central to public policy formulation.

The discussions involved collaboration between government bodies, strategic institutions, the Brazilian Association of Technical Standards (ABNT), and the National Telecommunications Agency (Anatel), reflecting a coordinated effort to promote responsible AI innovation and governance in Brazil. Together, the legislative and strategic approaches aim to bolster Brazil’s leadership in AI governance, combining clear regulatory frameworks with robust technical standardization to support safe, effective, and internationally aligned AI development.
