Supreme Court Crisis and Media Censorship Escalate Amid Tensions Involving Vorcaro Case

Brazil's Supreme Federal Court (STF) finds itself in a deepening crisis as President Edson Fachin awaits explanations from ministers André Mendonça and Alexandre de Moraes regarding mutual allegations and investigations involving suspected financial crimes tied to Daniel Vorcaro, a banker accused of committing billion-dollar fraud.

The conflict intensified last week with Mendonça publishing a Federal Police report that suggested a connection between Moraes and Vorcaro. Meanwhile, Moraes countered by calling for an investigation of Mendonça, citing abuse of authority based on an unsigned intelligence report suggesting manipulation of investigations for political purposes. Fachin is considering whether to convene a closed plenary session to address the matter or decide individually but remains constrained by STF internal regulations, which grant plenary authority over cases involving ministers. Fachin has set a deadline of September 11 for the ministers' responses.

Simultaneously, this judicial turmoil coincides with judicial censorship targeting press freedom. The Regional Electoral Court of Minas Gerais (TRE-MG) ordered the removal of reports by ICL Notícias covering messages between federal deputy Nikolas Ferreira (PL-MG) and Vorcaro, including a contested claim that Ferreira referred to Vorcaro as "lindão" (handsome). Judge Jair Francisco dos Santos partially granted Ferreira's request for removal, stating the audio evidence did not support the term's usage. Despite criticism and calls for reevaluation by the Brazilian Association of Investigative Journalism (Abraji), the censorship remains a pressing concern.

This measure drew broad condemnation from media watchdogs who see such actions as threats to the constitutional right of the public to be informed, especially regarding interactions involving politicians during an election period.

Adding to the judicial tensions, Minister Flávio Dino questioned the promise to end the protracted fake news inquiry—a controversial investigation initiated under former Minister Dias Toffoli—and stressed concerns about the judicial process being influenced by non-legal factors. Fachin recently emphasized the need to conclude this inquiry and establish a judicial code of ethics to ease internal court conflicts.

This multifaceted crisis highlights unprecedented internal divisions within Brazil’s highest court alongside growing pressures on media freedom and judicial accountability.
